Update on Pilot Program for Large Real Estate Developments

The British Columbia Financial Services Authority (BCFSA) has made important updates to its Pilot Program for Large Real Estate Developments (REDMA Early Marketing Period). Developers and real estate licensees should take note of these changes to ensure compliance and fully understand the advantages of participating in the Pilot Program.

What Developers Need to Know

Effective April 15, 2025, developers must apply for the REDMA Early Marketing Period - Pilot Program either before filing their disclosure statement or at the same time. This new requirement emphasizes the importance of planning early in the development process. For projects where a disclosure statement has already been filed, developers have until June 30, 2025, to apply for the program, provided they submit a disclosure statement amendment and meet the necessary data-sharing requirements.

The BCFSA first introduced the Pilot Program on February 25, 2025, to allow developers of projects with 100 or more units an 18-month early marketing period. The goal is to assess the impact of extended early marketing periods on both consumer rights and project viability. Developers participating in the program are required to share project data with the BCFSA, enabling an informed evaluation of the Pilot's outcomes.

Transition Period Concludes

Initially, developers with active projects beginning early marketing before February 25, 2025, were given a transition period to apply for an exemption and enroll in the Pilot. As of today, April 15, 2025, this transition period has ended for all new developments. Developers with existing disclosure statements filed prior to April 15, 2025, have their final opportunity to apply by June 30, 2025, after which participation will require the filing of a new disclosure statement.
